T&Cs for MyGuava Business POS Campaign
Guavapay Limited (“Guavapay”, or “We”) is the promoter of the MyGuava Business POS Campaign (the “Promotion”). We are registered with the Financial Conduct Authority as a Small Electronic Money Institution (SEMI) under number 900888 and registered as a limited liability company in England and Wales with company number 10601900 and with registered address at Monument Place, 24 Monument Street, London, EC3R 8AJ, United Kingdom. For the purposes of this Promotion, “Participant”, “you” or “your” shall refer to individuals who have fulfilled the requirements set forth in sections 1 and 2 of the Promotion.
By participating in this Promotion, the Participant agrees to the following terms and conditions:
1. Eligibility
1.1. Participants must be residents of the United Kingdom.
1.2. Participants must be 18+ years old.
1.3. Participant must:
(a) maintain an active MyGuava Business account in good standing; and
(b) have an active Point of Sale (POS) terminal service associated with their MyGuava Business account.
1.3.1 Any Participant who fails to meet these requirements or whose account or POS terminal service becomes inactive, suspended, or terminated during the Promotion period shall be automatically disqualified from participation and forfeiture of any prizes or benefits
1.4. The following individuals are not eligible to enter the Promotion:
- employees or consultants of Guavapay or its affiliates;
- anyone entering on behalf of another person.
1.5. Entry into the Promotion is available from 00:01 am on the 24th of July 2025 and will end at 11:59 pm on the 24th of August 2025 (the “Promotional Period”).
1.6. If you do not meet these criteria or cease to meet them before the Promotional Period ends, your entry will be automatically disqualified.
2. How do I enter?
2.1. For the purposes of this Promotion, there shall be one entry:
a. Primary entry: To qualify for the primary prize category in this Promotion, the Participants must complete a minimum of five hundred (500) Eligible Transactions during the Promotion Period.
2.2. The Participants must complete the form related to this Promotion.
2.3. For the purposes of this Promotion, an “Eligible Transaction” means transactions processed through the Participant’s active MyGuava Business POS terminal that:
- results in a successful debit of the customer’s payment method and a corresponding credit to the Participant’s MyGuava Business account;
- is not subsequently voided, refunded, reversed, disputed, or subject to chargeback;
- is not a test, training, or internal transfer transaction initiated by the Participant, its employees, agents, or affiliates; and
- complies in all respects with the MyGuava Account Terms and all applicable laws and regulations.
3. What is the prize?
3.1. Only One (1) Participant (the “winner”) will be randomly selected from the pool of eligible Participants and awarded the Primary Entry Prize during the Promotional Period.
3.2. The winner who meets the Primary entry requirements, as specified in clause 2.1.a shall be awarded one digital or physical gift card (a “prize”) with a face value of £300, redeemable at the Participant’s choice of any retailer included in Guavapay’s gift-card section.
3.3. The prize is non-transferable, non-exchangeable and cannot be exchanged for cash or any other alternatives.
4. Redeeming the prize
4.1. The prize will be issued in GBP and distributed to the winner’s MyGuava Business account, by email or courier after 30 calendar days of the end of the Promotional Period and confirmation of the Participant’s eligibility.
4.2. If any retailer becomes unable to honour the prize for reasons beyond Our control (e.g., insolvency or withdrawal from the Retailer List), We reserves the right to cancel, or substitute the affected gift card with another from a comparable retailer, without liability.
4.3. Prizes shall be considered redeemed and delivered once either uploaded to the winner’s MyGuava Business account or dispatched to either the address agreed upon with the winner after prize notification, or the Participant’s registered address on the MyGuava Business App.
4.4. Guavapay bears no responsibility for the winner’s failure to personally receive the prize, including but not limited to cases of incorrect address details, unavailability at the time of delivery, or third-party interference.
4.5. The risk of loss or non-receipt of Prizes transfers to the winner upon dispatch.
5. Disqualification and Final Decision
5.1. We reserve the right to disqualify any Participant from this Promotion, in whole or in part, at any time if the Promoter determines, in its sole discretion, that the Participant has:
- Breached any provision of these Terms and Conditions or any applicable specific promotion rules
- Fails to maintain an active MyGuava Business account or active POS terminal service as required under the eligibility requirements.
- Engages in fraudulent, artificial, or manipulated transaction activity, including but not limited to: a. Processing test transactions. b. Creates fake or sham transactions, c. Splits genuine transactions to artificially inflate transaction counts, d. Processes refunds with the intent to manipulate qualifying transaction totals.
5.2. Upon determination of any disqualifying conduct, the Participant shall be immediately disqualified from the Promotion without prior notice. Such disqualification shall result in:
- Complete loss of eligibility for any prizes, benefits, or recognition under this Promotion.
- Forfeiture of any prizes already awarded, which may be reclaimed at Our discretion.
- Potential prohibition from participating in future MyGuava Business promotions, at Our discretion.
5.3. Our decision is final, and no correspondence will be entered into regarding the outcome of the Promotion. We reserve the right to declare the Promotion void if We consider it unreasonable to proceed.
5.4. Participants who are disqualified shall have no claim for compensation, damages, or other remedies against Guavapay. Guavapay shall not be liable for any costs, expenses, or losses incurred by disqualified participants, including but not limited to legal fees, time invested, or business disruption.
6. Liability
6.1. Guavapay is not liable for any technical issues or malfunctions that may affect the entry process or result in a lost or incomplete entry. We are not responsible for any entries that are lost, delayed, illegible, corrupted, damaged, incomplete, or otherwise invalid.
6.2. To the extent permitted by applicable law, Guavapay’s liability under or in connection with the Promotion or these terms and conditions shall be limited to the cost price of the prize in question.
6.3. Guavapay will not be liable for any loss, whether directly or indirectly suffered where We are unable to continue running the Promotion as planned.
7. Your Personal Data
7.1. If you register to participate in the Promotion, We will use your information in accordance with these terms and conditions and our Privacy Policy, which explains how We will use, disclose, transfer, and store your personal data, and sets out your rights to your personal data: myguava.com/legal/privacy-policy.
8. Additional Terms and Conditions
8.1. This Promotion is a one-sided campaign, where only Guavapay customers can be awarded the prize.
8.2. Participants must be in full compliance with your Account Terms and/or any other terms and conditions that apply to your MyGuava and MyGuava Business account.
8.3. Guavapay reserves the right to alter the T&C, cancel or terminate the Promotion at any time, for any reason, without prior notice or liability. In the event of cancellation, any obligations incurred up to the date of cancellation shall remain in effect.
8.4. Guavapay reserves the right to terminate or temporarily suspend this Promotion in the event of technical or other difficulties that might compromise its integrity, though We will endeavor to minimise the impact on participants.
8.5. We reserve the right to reverse any prize if We become aware that you have breached any of these Promotion terms.
8.6. If We believe that you have engaged in any fraud or material abuse of this Promotion, We may, at our sole discretion, take any actions We see fit.
8.7. If We need to change, suspend or end the Promotion before the end of the Promotional Period, We will use our reasonable endeavours to give you notice through the app and/or email.
8.8. By participating, You consent to the use of your name and photo/video or any other personal data voluntarily submitted by you (where applicable) for marketing and publicity purposes.
8.9. These terms and conditions are published in English. Any translation is a courtesy translation only. This means you cannot derive any rights from any translated version, and only the English version can be used in legal proceedings.
9. Governing Law and Jurisdiction
9.1. These terms and conditions are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to determine any dispute relating to these terms and conditions.
